These terms

These terms apply to your use of this website and to any work sample we release to you. The terms of any paid engagement are set out in a separate written agreement between us; where that agreement and these terms differ, that agreement takes precedence.
This site is operated by Virtual Assist X Ltd, registered in England and Wales, at 61 Bridge Street, Kington, Herefordshire, HR5 3DJ.

What we do

We provide records review support to Life Care Planners and other professionals: organising, ordering and citing records so the planner can work from a prepared record set. We work behind our client’s name and the deliverable carries the client’s name.
We do not practise law, medicine, nursing or life care planning. Nothing we produce is a legal opinion, a medical opinion, a life care plan, or expert testimony. The professional opinion, the methodology, and the responsibility for reviewing the record set before relying on it remain with the client.

The work sample

The work sample is built from a synthetic file. It is released after a signed non-disclosure agreement and is watermarked to the person who receives it.
It is provided for your assessment only. You may not copy, publish, or pass it to anyone outside your practice, and you may not use it in a live matter. The sample and everything in it remains our property.

Engagements, scope and fees

Scope, fees, and dates are agreed case by case in writing before work begins. Nothing on this website is an offer at a fixed price.
Where a date is agreed it is based on the volume and condition of the materials as described at the time. If more material arrives, or the material differs materially from what was described, we will tell you promptly and agree a revised date or scope with you.

Your materials and your authority

When you send us case materials you confirm that you are entitled to share them with us for the purpose of the engagement, and that any authorisation or consent required from the individual concerned, or from the instructing firm, is in place.
We handle those materials under the confidentiality agreement signed with you and on your instructions, and we delete them on the schedule set out in our privacy policy.

Confidentiality

Confidentiality runs both ways and is signed before any file changes hands. We do not identify our clients or their matters, and we do not use client materials as examples.

Intellectual property

Deliverables prepared for an engagement belong to the client on payment. The methods, templates and internal tooling we use to produce them remain ours. Website content, including copy and design, belongs to Virtual Assist X Ltd.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our liability arising out of an engagement is limited to the fees paid for that engagement, and we are not liable for loss of profit, loss of business, or indirect or consequential loss. The client is responsible for reviewing the record set and for the opinions and reports issued under the client’s own name.

Ending an engagement

Either of us may end an engagement in writing. Work completed up to that point is payable, materials are returned or deleted as the client directs, and the confidentiality obligations continue.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
